V. Requirements for the use of the trademark
The trademark owner must file an affidavit of use between the 5th and 6th year after registration in order to maintain the trademark registration.
The revised filing requirements for the affidavit are the result of the COVID-19 situation and DIPR's initiative to improve workflow and promote automation through its online filing system. Under the new requirements, the following documents must be submitted:
A notarized power of attorney;
a copy of the most recent trademark certificate; and
A proof of use (if filing an affidavit of use).
Since a signed original declaration of use is no longer required, the domestic trademark agent will declare "use" or "non-use" on behalf of the trademark owner. Trademark owners should note that proof of use of a registered trademark in Cambodia is now required whenever an affidavit of use is filed.
These requirements apply to both domestic registrations and international registrations under the Madrid Protocol.
