Explanation of our Consulting Services and the Process for Design Renewal in the United Kingdom

Our law firm handles the renewal of your design protection in the United Kingdom and ensures that your design remains protected without interruption. We monitor the protection period of your design and notify you in advance when renewal is necessary. Protection can be extended every five years, and we ensure that these renewals are carried out on time and without any issues. Design protection can last up to 25 years, with the protection period being extended every five years for a total of four renewals.

1. Monitoring the Protection Period and Timely Notification

Once your design is registered in the United Kingdom, protection is granted for an initial period of five years, starting from the filing date. We monitor the expiry of the protection period and notify you in advance of the upcoming renewal. This ensures that your design remains continuously protected, and no deadlines are missed.

2. Renewal of Design Protection

Design protection in the UK can be extended up to four times, each time for five years, allowing for a total protection duration of up to 25 years. The renewal is done by submitting an application to the relevant office and paying the required renewal fee on time. The fee can be paid no earlier than six months before the protection period ends and must be paid at least one month after the protection period expires to avoid late payment fees.

3. Late Payment and Surcharge Fees

If the renewal fee is paid after the protection period has expired, a surcharge fee will apply. This surcharge is added to the official fee for each late payment. If the renewal is not applied for and paid on time, it is possible to renew it within a grace period of 6 months after the protection period ends, subject to payment of a surcharge.

In exceptional cases, if there are valid reasons, a reinstatement can be requested within 12 months after the protection period expires, as long as there are good reasons for reinstating the missed deadlines.

4. Required Information and Documents for Appointment

To proceed with the renewal, we will need the registration number of your design as well as the filing date. This information is necessary to submit the renewal application correctly and to keep track of the protection period. The earlier you appoint us for the renewal, the more securely we can ensure that all deadlines are met.

5. Costs and Fees

The prices for design renewal in the UK are charged per design and per protection period. The prices include the official fees as well as the applicable VAT. Additional costs for late payments or reinstatement applications are not included in the price and must be paid separately. These additional costs are not part of the standard order and must be paid separately.

6. Early Appointment for Timely Renewal

To ensure that your renewal is carried out on time and without surcharge fees, we recommend appointing us early for the renewal. This way, we can initiate the application and payment of official fees before the protection period expires, avoiding any additional costs.
