Duration of Protection and Extension Options
In Uganda, the maximum protection duration for a registered design is 25 years. The protection is structured as follows:
- Initial protection period: 5 years from the filing date.
- Extension possibilities: Up to four extensions of 5 years each.
Each extension must be applied for in a timely manner to maintain uninterrupted protection.
Steps in the Extension Process
The extension of a design in Uganda is carried out by:
- Filing a formal application: This can be done up to 6 months before the end of the protection period.
- Payment of renewal fees: Fees must be paid within the protection period or no later than 1 month after the end of the protection period to avoid penalties.
Grace Period and Late Fees
If the regular deadline for extension is missed, a grace period of 6 months is available. During this time, the protection can be extended by paying a late fee.
In exceptional cases, a reinstatement request may be submitted if deadlines are exceeded by up to 12 months. Such requests require valid reasons and are subject to additional fees.
