Renewal of Design in Spain

Upon registration of a design in Spain it shall be protected by a registered industrial design for a period of five years from the date of filing the application or the claimed priority application date. The applicant may have renewed the term of protection for one or more periods of five years each, up to a total term of 25 years from the date of filing. The renewal of a registered design shall be done by a request, provided that the renewal fee will be paid too. The request for renewal shall be submitted within the last 6 months of the protection period and the renewal fee shall be paid within the same period. Renewal shall have effect from the expiry of the registration.

The renewal still may be done during the six months following the expiry date of the registration, subject to simultaneous payment of an additional fee which will be 25 % in the 1-3 month of delay and 50 % by delay with more than 3 months.

Our offer relates to single design registration and includes the general maintenance fee but not the additional fee for late renewal payment in case of failing the general time for renewal.

Accepting the contract is subject to the circumstance that you will hire us early enough so that the request and the payment of the official fees can be arranged in time.
