Industrial design registration in South Africa starts with a 3-year term, beginning with the date of the lodgement. Before the expiry of the first 3 years from that date, a maintenance fee must be paid yearly to maintain protection. Otherwise the exclusive protection will end. Your industrial design may become free to be used by others.

An industrial design in South Africa can be an aesthetic design (where the beauty of the design is built by its shape, configuration or ornamentation) or a functional design (where the shape or configuration is necessitated by the function). You may have applied for an aesthetic or a functional design or both: The aesthetic design will be found as recorded in part A of the Design Register, and the functional design will be recorded in part F of the Design Register. If you wish to have both aesthetic and functional design renewed, you have to file separate renewal orders. You even will have to pay the registration fee for each of it separately.

An aesthetic industrial design in South Africa is valid for one period of 15 years subject to payment of annual renewal fees starting from the end of first protection period (3 years from the date of filing).

An aesthetic industrial design in South Africa is valid for one period of 10 years subject to payment of annual renewal fees starting from the end of first protection period (3 years from the date of filing).

The renewal of a registered industrial design in South Africa will be done by a request, provided that the renewal fee will be paid too. The request for renewal shall be submitted within the protection period and the yearly renewal fee shall be paid too within a period of 12 months before the regular protection period ends.

In South Africa the renewal fees can even be paid in advanced for one year or more than one years or as well for the whole period of possible design protection if the applicant so wishes.

Even in cases where the request or payment for renewal was delayed but not longer than 6 months from the due date a fine must be paid for the first month plus thereafter for each started new month - not exceeding five months - in addition to the renewal fee. Once the late renewal period of 6 months has past by then only a request for restoration may help you to renew your design.

Our offer relates to the renewal of a single design for a single protection period and includes the general maintenance fee for one more year only but not the additional fee for late renewal or late renewal payment in case of failing the general renewal period. The offer does not include a request for restoration if general and late renewal time limit have past.

But you are free to order here instead of a yearly renewal the renewal for the remaining full period of protection if you wish so.
