The total term of design patent protection in Taiwan is 12 years.
Design patent registration in Taiwan starts with a 1-year term, beginning on the date of application. To maintain the Design annual maintenance fee must be paid or protection will end. Once the 12-year term is over, anyone is free to produce, import, rent or sell the design in Taiwan.
The annuity for an design patent shall be paid starting from the publication date. Payment of the second-year annuity and the annuities thereafter shall be made before the period thereof expires.
The annuity for several years may be paid at one time. Under such circumstance, if the annuity rate is adjusted upward, the patentee concerned will not be required to pay the deficit.
Our offer relates to single design patents and includes the general maintenance fee but not the additional fee for late payment in case of failing the general renewal time limit.
