Maximum Protection Period and Calculation Basis
A registered design in Italy is protected for a maximum period of 25 years. The protection period begins on the filing date or the earlier claimed filing date (priority date) if a priority has been claimed.
Details on Protection Duration and Renewal Options
After registration in the official register, the design is initially protected for a first period of 5 years. The protection can be renewed up to four times, each for a period of 5 years. The maximum protection period of 25 years is achieved through timely renewals. Each renewal takes effect at the end of the previous protection period.
The Renewal Process
The renewal of design protection is carried out through a formal application and timely payment of renewal fees:
- The renewal application can be filed no earlier than 3 months before the expiration of the current protection period.
- The application must be submitted no later than 6 months after the end of the protection period.
- The renewal fees must be paid together with the application within the same period. A late payment incurs an official surcharge.
