Maximum Protection Period and Renewal Options
A registered design in Iceland can be protected for a maximum duration of 25 years. The protection is structured as follows:
- Initial Protection Period: 5 years starting from the filing date or claimed priority date.
- Renewals: Up to four extensions, each for 5 years, are possible.
Renewal Process
The renewal of your design involves:
- Submission of a formal renewal application to the Icelandic Patent Office.
- Payment of the renewal fee, which must be made at the time of application.
Deadlines for Renewal
The renewal application can be submitted no earlier than three months before the end of the protection period. The application and fee must be received by the office no later than six months after the end of the protection period to avoid a lapse in protection. If the renewal is late, a surcharge will be applied.
Renewals are retroactively effective from the expiration date of the previous protection period.
