Maximum term of design protection in Brazil is 25 years.
Upon registration of a design in Brazil the registered design shall be protected by registered industrial design for a period of 10 years from the date of filing the application (or the claimed prior application date), provided that the maintenance fee is paid with in the fifth year too. Late payment will leed to the end of the registration! If the maintenance fee is paid duely the request for renewal only may be filed within the next 6 months after the expiry of the design right.
The right holder may have renewed the term of protection for 3 periods of five years each, up to a total term of 25 years from the date of filing. The renewal of a registered industrial design shall be done by a request, provided that the renewal fee will be within the last year of protection. The request for renewal shall be submitted within the last year months of the protection period but may - if the renewal fee are paid duely - be field within the 6 months after the expiry date of the last protection period.
Our offer relates to the renewal of a single design registration and includes the general maintenance fee but not the additional fee for late renewal in case of failing the general time for renewal request.
