2. Renewal of Design Protection
The maximum protection duration for an industrial design in Brazil is 25 years. Initially, the design is protected for a period of 10 years. In the 5th year after filing, a maintenance fee must be paid to ensure protection for the second five-year period. This payment must be made in the last year of the initial protection period. If the fee is not paid on time, you may still apply for renewal within an additional six-month grace period, though a surcharge fee will be applied.
After the payment of the maintenance fee in the 5th year, the protection can be extended for up to three additional periods of five years each, allowing a total protection period of 25 years. The renewal is done through an application to the relevant office and the timely payment of the required renewal fee.
The renewal application must also be submitted in the final year before the respective protection period expires and must be paid within six months after the protection period ends.
3. Surcharge for Late Payment
If the required fee is paid after the protection period has expired, a surcharge fee will apply. This fee is charged starting from the first month after the expiration of the protection period and is a percentage of the regular renewal fees.
