- After registration in the official register, a design is initially protected for a first period of 25 years.
- The protection can then be extended by a single renewal for an additional 25 years, reaching the maximum duration of 50 years.
2. Start of Protection and Renewal Process
Protection begins with the date of registration of the design. To extend protection beyond the first period, a formal renewal application must be submitted to the relevant authority, along with the timely payment of renewal fees.
The renewal becomes effective at the end of the previous protection period and should be applied for during the final months of the current protection period.
3. Deadlines for Renewal
Renewal must be completed before the end of the respective protection period.
- Renewal can still be completed up to 6 months after the protection period expires with a late fee surcharge.
- If these deadlines are not met, the design protection will permanently lapse.
The official fees must be paid along with the renewal application. Timely submission and payment are crucial to avoid additional fees or loss of protection.
4. Late Renewal and Surcharges
If renewal is completed within the 6 months after the protection period expires, a late fee surcharge will be added to the regular fee. This surcharge is calculated per late month. Further renewal or reinstatement is not possible beyond this grace period.
