Renewal of Design in Hungary

The maximum term of design protection in Hungary is 25 years. The protection starts with the day of filing of the application at Hipo - the hungarian intellectual property office or the claimed prior application date (priority date).

Upon registration of a design in Hungary it shall be protected by a registered industrial design for a period of five years from the date of filing the application (or the claimed prior application date). The right holder may have renewed the term of protection for one or more periods of five years each, up to the total term of 25 years.

The renewal of a registered design in Hungary shall be done by a formal request, provided that the renewal fee will be paid too. Both shall be done within the protection period. Renewal shall have effect from the expiry of the registration.

The request for renewal may be submitted to the office within the last months of the current protection period and the renewal fee shall be paid within the same period. The request and payment must have been done at least within the first 6 months after the expiry of the current protection period. If this possibility for renewal was failed the design will become free to use.

Where during the period of 6 months after the expiry day renewal is requested a late renewal fee has to be paid additionally.

Our offer relates to the renewal of a single design registration and includes the general renewal fee but not the additional fee for late renewal in case of failing the general time for renewal.

In Hungary the renewal of design protection granted for several designs may also be requested in respect of only a part of those designs (partial renewal). Insofar you may use our offer to renew several design of the same application or registration.

Accepting the contract is subject to the circumstance that you will hire us early enough so that the request and the payment of the official fees can be arranged in time.
