Explanation of our Consulting Services and the Process for Design Renewal of the Registered Community Design in the European Union
Our law firm offers comprehensive support for the renewal of your registered Community Design in the European Union. Design protection grants you exclusive rights to the external appearance of a product. Timely renewal of the design is necessary to maintain this protection. With the renewal, the protection period of your design can be extended to a total of 25 years.
1. Monitoring the Protection Period and Timely Notification
We continuously monitor the protection period of your registered Community Design and inform you in advance about the upcoming renewals. Through this proactive approach, we ensure that you do not miss any deadlines and that your design is renewed on time. We will send you a timely reminder so that the renewal can be carried out without delay.
2. Renewal of the Community Design
Once registered, a Community Design is protected for five years from the filing date (or priority date, if applicable). This protection can be extended up to four times, each time by five years, allowing for a total duration of up to 25 years.
The renewal takes place upon filing an application with the office and requires the payment of the applicable renewal fees. The renewal application can be filed no earlier than six months before the end of the protection period. Additionally, an application can be submitted within a grace period of up to six months after the protection period has expired, although a surcharge of 25% is applied in this case.
3. Deadlines and Fees
The design renewal must be applied for within a six-month period before the expiration of the protection period. If this period is missed, an additional grace period of up to six months is available during which the renewal can still be made. However, in this case, a 25% surcharge on the regular renewal fees will be charged.
Our law firm ensures that all applications are filed on time and the necessary fees are paid correctly so that your design remains protected without interruption.
4. Required Information and Documents for Appointment
For the renewal appointment, we will need the following information from you:
- Registration number of your registered Community Design.
- Filing date or, if applicable, the priority date. With this information, we can efficiently initiate the renewal process and ensure that no deadlines are missed.
5. Our Comprehensive Services in Detail:
- Legal advice and monitoring: We advise you on the legal requirements for the renewal and ensure that all necessary steps in the process are carried out on time and correctly.
- Preparation and submission of the renewal application: We handle the complete preparation of the application and its timely submission to the relevant office.
- Payment of official fees: We take care of the payment of the regular renewal fees as well as the surcharge in the event of a late renewal.
- Long-term support: Even after the renewal of your design, we continue to provide legal support in all matters related to your design, such as registering new designs or enforcing your design rights.
6. Costs and Fees
The prices for the renewal are per registered Community Design and include the official fees. Additionally, the statutory VAT will apply. If you need to apply for a renewal after the protection period has expired, a 25% surcharge will be applied.
