Process of Design Renewal and Re-registration
Design law in China grants protection for up to 15 years without the option for extension. To maintain protection, it is necessary to re-register in a timely manner.
A new application should ideally be submitted six months before the current protection period expires to ensure seamless protection. After submission, the Chinese Patent and Trademark Office (CNIPA) will conduct a review. Once all requirements are met, protection is granted for another 15 years.
In exceptional cases, a new application can be filed within six months after the protection period has expired, but this will incur an additional fee.
