1. Monitoring the Protection Period and Timely Notification
Once your design is registered, the protection begins for a period of 5 years, typically starting from the filing date (or priority date, if applicable). 2. Renewal of Design Protection
Design protection can be extended up to four times, each time by 5 years, making the total possible protection period 25 years. The renewal is done by submitting an application to the relevant office and paying the necessary renewal fee.
The renewal application must be submitted within a 12-month period before the protection expires. During this period, the renewal fee must also be paid to continue the protection.
3. Grace Period and Surcharge
If the standard time for submitting the renewal application and paying the renewal fee is missed, there is still an opportunity to renew the design within a 6-month grace period after the protection expires. However, a surcharge will apply in this case, which must be paid in addition to the regular renewal fee.
